When are assessments due?
A. Assessments
are due on January 1st each year.

What are the state assessments regulations?
A. The State of
Florida regulates and enforces the collection and posting of assessments.
Florida statute 721.15 specifically states, no owner may be excused
from the payment of assessments including late fees, if applicable.
Florida statute 718.116 regulates the order in which payments collected
are applied to an account. Any payments received by the Association
shall be first applied to any interest accrued by the Association,
(Note: The Islander does not charge interest), then to any administrative
late fee, then to any costs and reasonable attorney fees recurred
in collection, then to the delinquent assessment.
For example: If you have 2001 property taxes due, these will be credited
first, then the balance of the payment will be credited to your 2002
assessment. If you have an outstanding assessment balance on March
1, 2002, it will be subject to a late fee, which cannot be waived.
Q.
When can I inspect association records?
A.
Official records of the Islander Beach Club Condominium Association
of Volusia County , Inc., are open to inspection by any association
member or their authorized representative.
The right to inspect records includes the right to make or obtain
copies, at a rate of$.25 per page, at the association members expense.
Records will be available for review within ten (10) working days
after receipt of a written request.
Owners may review association records at the Islander Beach Resort
administrative offices located at 1601 South Atlantic Ave., New Smyrna
Beach, Florida, between the hours of 10:00 a.m. -noon & 1:00-5:00
p.m., Tuesday through Friday, excluding holidays.
Original documents of the Association may not be removed from the
property. Any other means of duplicating records except photo copying,
must be approved by Islander Management or the Board of Directors.
Q.
What are the rules for video taping board meetings?
A.
State statute only authorizes the use of tape recorders and video
tape recorders. However, any owner wishing to use alternate recording
devices may do so, provided they have permission from the Board. Requests
for alternate recording devices must be received by the Board no less
then (10) days in advance. Use of alternate recording devices will
be subject to the same restrictions as tape and video recorders.
Restrictions:
a) Equipment must not produce distracting sound or light emissions.
b) Equipment shall be assembled and placed in position in advance
of the commencement of the meeting.
c) Anyone recording a meeting shall not be permitted to move about
the meeting in order to facilitate the recording.
d) Advance written notice of forty-eight ( 48) hours shall be given
to the Board or Resort Management, by any unit owner desiring to utilize
recording equipment.
e) Recordings are to be for personal use or Association related matters
and may not be publicly broadcast or distributed without written consent
of the Board.
t) Recording may not be edited or enhanced.
g) If recordings are to be used for litigation or administrative purposes,
any excerpt used must be of such length as to provide a truthful portrayal
of the event. Dialogue may not be used out of context.
h) These rules may be amended by the Board as needed. .
i) Any owner's willful failure to comply with these rules may be subject
to litigation. In the event of litigation arising hereunder, the prevailing
party shall be entitled to award of attorney fees and costs.

What is spacebanking?
A. This is the system of "banking" time for future usage
provided thru RCI and II.
Q.
Can I save my vacation week?
A. Vacation weeks
may be held over from one year to the next by spacebanking your confirmed
week. RCI will hold your time for 2 years from the date of the spacebanked
week. To use your week during a different year, simply submit an exchange
request form or call RCI. Reminder: The week you spacebank does not
have to be the week you plan to travel.
Q.
What is a "Lock-Out"?
A.Florida
Statute 721. (Timeshare) which became effective October 1, 1988, entitled
"lockout and Administration"gives power to Timeshare Associations
to resolve the problem of collecting delinquent monies from owners.
It authorizes the managing entity to "lock out" and deny
the use of the resort accommodations and facilities to any owner with
delinquent assessments. RCI, once notified, by the resort will deny
spacebanking, cancel confirmed exchanges and freeze an owners exchange
privileges until assessments are current.
Q. I am unable to come use my week, can it
be rented?
A.
Owners not wishing to use their vacation week have the option to allow
the reservations department to rent their week, allow another company
to rent it for them or rent it out themselves. If you would like the
resort to place your unit on the rental market, you are required to
notify the reservations department, in writing, no later than 30 days
prior to the reservation start date. The rental of the suite cannot
be guaranteed, and it's up to the owner to solicit information from
the reservations department as to the status of their rental. There
is a 30% rental commission charge for this service.

What happens if I do not make a reservation for my vacation week?
A.Owners
not submitting a reservation request by deadline, july 31, will
automatically be assigned a week from the remaining unscheduled weeks.
You will receive a confirmation. You then have the option to either
use, rent, spacebank, or loan your vacation week to family members
or friends.
Q.When
I send my reservation request form back and I've indicated that I
will be Spacebanking, why isn't my week spacebanked for me?
A.Owners
may spacebank with an exchange company of their choice. Most exchange
companies will only accept bankings from the owner. We ask for your
intentions so if an exchange company calls to verify your reservation,
we know to release your week. Also many times owners change their
minds about how they plan to use their vacation week. Therefore it
is the owners responsibility to spacebank their vacation week.

When are late fees assessed?
A. A $25 late
fee is assessed to all delinquent accounts on March 1st.

Is there a charge for changing my confirmed reservations?
A. There is a
$25 charge to change your confirmed reservations.

Can I send a guest to use my vacation week?
A. Yes, please
notify the resort in writing prior to check-in. Walk-in notification
by the guest or phone calls will not be accepted for transfer of occupancy.

What time is check-in / check-out?
A. Check-in starts
at 4:00pm. If you arrive early you may pre-register and use the resort
facilities until your unit is ready. Changing rooms and lockers are
available for your use. Check-out by 10:00am is strictly enforced
so we can stay on schedule to have suites ready on time to accommodate
our incoming guests.

How close are you to the Central Florida attractions?
A. The Islander
is centrally located to reach all the Central Florida attractions
in just over an hours drive. The Orlando area attractions, Walt Disney
World, EPCOT, MGM Studios, Pleasure Island, Universal Studios, Islands
of Adventure, City Walk, Sea World and numerous theatrical dinner
shows can be reached via I-4. The Kennedy Space Center and Casino
boats at Port Canaveral are south on I-95 while historic St. Augustine
is to the north. A short drive away using Interstate 95, brings you
to the Daytona International Speedway, Daytona USA and the Daytona
Kennel Club featuring greyhound racing. Daytonas world famous
Boardwalk and Lighthouse can be reached by using US1.

Can minors stay at the Islander unsupervised?
A. If you are
planning to send your children under 21 years of age to the resort
to use your week (even if they are on the deed), please be aware.
We require an adult be on site at all times to supervise them. We
recognize this may be an inconvenience to you but your children do
not always behave as they promised when you agreed to let them come!
Be considerate of your fellow owners. This is their vacation time
too. Parents please supervise your children.

What is the parking policy?
Parking is assigned-
ONE VEHICLE per unit. Please keep this in mind when you travel here
during our peak seasons. We have very little space for boats, towing
or travel trailors, second cars or, oversized vehicles, requiring
more then one parking space. Only one vehicle will recieve a parking
pass for the islander lot.
Q. What
is a Bonus day?
A. A Bonus day
is a reduced rental available to Islander owners only, when reservations
are made seven (7) days in advance of your stay or less.
Q. Where do Bonus days come from?
A. When
an owner puts their vacation week up for rent, they have the option
to accept a reduced rate rental if their vacation days haven’t
rented seven (7) days prior to the start of their week. Owners accepting
the reduced rate do not have any service fees taken out of the Bonus
day rental.
Q. When
are Bonus days available?
A. Bonus days
are available at various times throughout year. It depends on the
demand for full rate rentals. The busier the season, the less availability
there will be for Bonus days. There may be times when full rate rentals
are available but Bonus days are not. Bonus days are only available
if an owner has authorized the resort to rent their unit at the lower
rate. Bonus days are usually Monday through Thursday.
Q. When
can I book a Bonus day?
A. Bonus day reservations
can be made seven (7) days or less before the time you want to stay.
Q. How
many Bonus days can I use each year and is there a minimum number
of days that must be taken at a time?
A. Owners can
book up to seven (7) Bonus days per year and take them one (1) day
at a time.
Q. Can
I get a special unit type for Bonus days?
A. Unit type availability
depends upon what type of room is authorized for reduced a rate and
not rented seven days in advance of your stay.
Q. What
is the cost of a Bonus day?
A. The Bonus day
rate is $45 plus tax for any size unit available.
